ART. 1 - GENERAL INFORMATION MANDATORY TO THE BUYER

Pursuant to art. 7 of D.L.vo 9 April 2003, n. 70, the seller informs the buyer that the goods/services covered by this contract are provided by Egea di Gianluca Pellegrini, with registered office in Via Venti Settembre 142 - 37129 Verona(VR), VAT 04224550238.

Any communication or request for information can be sent in writing to: Egea di Gianluca Pellegrini, Via Venti Settembre 142 - 37129 Verona (VR) or by e-mail to info@egeajewels.com.

Egea by Gianluca Pellegrini, henceforth called "Seller", offers on its website sales services of products, hereinafter the "Services", related to the brand EGEA jewels. Users who register and wish to use the Services, accept the general conditions set out herein.

ART. 2 - CONCLUSION OF THE CONTRACT

Users have the possibility to place all their orders from the pages of the website www.egeajewels.com.

Each user declares that he has the full right to use credit cards or other payment instruments that can be used on the site egeajewels.com and that they have sufficient credit to cover all costs related to the purchase of products through egeajewels.com.

By selecting the "Order Confirmation" button during the payment process, the user declares to fully and unreservedly accept the totality of these General Conditions of Sale.

The recorded data constitute the proof of the transactions made between the Seller and the users. The Seller will confirm receipt of the order by sending an e-mail and/or automated messages on video. The prices of the goods/services provided, any taxes and charges, as well as the additional costs for shipping and packaging are indicated precisely during the definition of the order, before the confirmation of the same and before payment.

The discount and price comparison are calculated using the list prices communicated by the Seller. The Seller reserves the right to change prices at any time, but the products will be invoiced on the basis of the rates in force at the time of storing the orders (upon reservation of product availability).

The products remain the property of the Seller until the total settlement of the amount due.

The Seller reserves the right to refuse an order of any user with whom there is a dispute.

  1. The goods are sold and purchased in accordance with an order of the buyer sent by the same and accepted by the Seller in the manner set out in point 2 below. The order is subject to these conditions governing the contract in such a way as to exclude any other terms and conditions under which an order may be made by the buyer.
  2. Once you have viewed the products you can choose the one of interest by selecting the "Purchase" button, this will show a summary page containing data on the price of the product. By selecting the "Add to cart" button you can book the desired product. On the next screen, the user can check the types of products they want to buy and their prices and at this point it will be possible to confirm the order, cancel it or modify it.
  3. The seller, pursuant to art. 13 of the recalled D.Lgs.vo n. 70 of 2003, verified the availability of the chosen product, issues acceptance of the buyer’s order, without undue delay and by e-mail containing a summary of the general conditions and details applicable to the contract, information on the essential characteristics of the goods or services and details of the price, means of payment, withdrawal, delivery costs and applicable taxes.

Once the purchase order has been confirmed, the buyer has the possibility to verify the details at any time on the relevant web page.

ART. 3 - PRICES

The prices of the goods/services provided, any taxes and charges, as well as the additional costs for shipping and packaging are indicated precisely during the definition of the order, before the confirmation of the same.

ART. 4 - PRODUCT DESCRIPTIONS

The descriptions of the products offered by the Seller are published on the internet site egeajewels.com.

The Seller undertakes to make every effort to correct errors and omissions that may occur in the product descriptions as soon as possible.

ART. 5 - DELIVERY

The products for which the order has been accepted by the Seller will be delivered to the address indicated by the buyer in the purchase order, courier after about 2 weeks from the end of the sales campaign and in any case within 30 days from the day after the day on which the buyer has sent the order, unless different specific information is clearly stated on the site. The times are greater than other online sales services because they are constrained by the fact that the Seller works without stock, which on the other hand is one of the main reasons that allows you to keep prices so low.

If there is no communication within 3 working days from the Seller to the Buyer by email or phone of the same Buyer entered in the order form, the order will be in processing and in the time described here shipped.

The delivery takes place by forwarding agents and/or couriers at the shipping cost indicated on the screen during the completion of the order, calculated according to the weight, volume and destination of the goods.

The cost of the shipment is borne by the buyer, according to the rates and costs indicated.

The buyer can always know at what point is the processing of each of his orders by sending a request for information to info@egeajewels.com or via dedicated page (if available).

Each delivery is considered completed from the moment the carrier makes the products available to the buyer, according to the system used by the carrier to track shipments. It is the responsibility of the recipient to verify the products at the time of delivery and to raise any reservations and complaints that appear justified, including the possibility of refusing the package if it has been opened or bears obvious signs of deterioration.

Reservations and complaints must be addressed to the Seller by registered letter a.r. or by e-mail to the addresses indicated in art. 1.

ART. 6 - PAYMENT

  1. The balance of purchases is made via PayPal, Credit Card or Prepaid Card. The cards accepted are all those belonging to the circuits Visa, Visa Electron, Postepay and MasterCard.
  2. For greater security only the banking partner has access to the data of the card used for payment, while the Seller has no possibility to know or store such data.
  3. The purchase price will be charged to the buyer’s bank account within 4 days from the day of the order and will be effective after the confirmation of authorization by the banking service center.
  4. In the event that the virtual POS (point of sale terminal on the Internet) communicates the refusal of the card, the order will be automatically cancelled, informing the buyer of the aforementioned cancellation online.
  5. In case of unavailability of the product after the order has already been made, the buyer will be informed by e-mail of its cancellation. As a result of this cancellation, the speed of crediting the buyer’s bank account will depend on the type of credit card and the conditions of each bank.

ART. 7 - RIGHT OF WITHDRAWAL

  1. The buyer has the right to withdraw from the contract stipulated under these general conditions, without any penalty and without specifying the reason, within eight working days from the day of receipt of the goods by the buyer, pursuant to art. 64 et seq. of the Consumer Code (D. L.vo 22.07.2005 n. 206).
  2. The right of withdrawal is exercised with the shipment, within the deadline, a communication sent to the address indicated in art. 1 by registered letter with acknowledgement of receipt. The communication can be sent, within the same period, also by e-mail to the addresses and numbers indicated in art. 1. The Seller will respond by e-mail providing detailed instructions for return.
  3. If the delivery of the goods has taken place, the buyer who sent the withdrawal must return the goods by shipment of the same in a period not exceeding eight days from the date of receipt. The costs and risks related to the return of the products will be borne by the buyer, who must send them in a safe form with the guarantees necessary for the products to arrive in perfect condition. The only charges payable by the purchaser for exercising the right of withdrawal pursuant to this article are the shipping costs of the goods to the seller. In case of payment made before the exercise of the right of withdrawal, the Seller is obliged to refund the amount paid, within thirty days from the date on which he became aware of the exercise of the withdrawal.
  4. The return may not take place under any circumstances if the products supplied have clearly been used. The products must be returned with the appropriate protections, in their original packaging, in perfect condition (not damaged or soiled), with all the accessories, instructions and documentation, with the identification tag and labels still attached. Nor will it be possible to accept returns of packages on which there is no element that allows the identification of the sender (order, name, address).

ART. 8 - GUARANTEE OF CONFORMITY OF GOODS

The Seller is liable to the buyer for any lack of conformity of the goods purchased pursuant to and for the effects of the provisions of the Consumer Code (Title III - Legal guarantee of conformity and commercial guarantees for consumer goods, CHAPTER I Of the sale of consumer goods, Art. 128 and Art. D. L.vo 22.07.2005 No. 206)provided that it exists at the time of delivery of the goods and has occurred within a period of one year from the moment of receipt of the goods and provided that it is not a defect known to the buyer at the time of conclusion of the purchase contract.

Any defect must be communicated to the Seller (who will then notify the Supplier of the product) within two months of its detection, by sending registered mail to. r. at the address referred to in art. 1. The date of the postmark on which the registered letter is sent shall be authentic between the parties.

ART. 9 - INTELLECTUAL PROPERTY

The Seller reserves all rights to the texts, works, illustrations and images reproduced on the web pages of the site egeajewels.com in accordance with copyright as well as in accordance with the Intellectual Property.

In this regard and in accordance with the provisions of the Intellectual Property Law, we authorize the use only for private use unless otherwise provided, including further restrictions of the Intellectual Property Code.

Any other use is intended as falsification and is sanctioned in accordance with the Intellectual Property, except with the prior written permission of the Supplier. All total or partial reproductions of the catalogue on the egeajewels.com website are strictly prohibited.

ART. 10 - LIABILITY AND SETTLEMENT OF DISPUTES

The photographs and texts reproduced to illustrate the products offered are not contractual. Consequently, the Seller will not be liable in case of errors in any advertising of the products on sale.

The Seller shall not be liable for any damage caused, whether material, immaterial or bodily, that may result from a malfunction or misuse of the products marketed.

The Seller’s liability, in any case, will be limited to the amount of the order and will not be required for simple errors or omissions that may have existed despite all the precautions taken in the presentation of the products.

The Seller shall not be liable in front of a buyer or a third party for any indirect damage, loss, profit or volume of business that occurred in any way, even if they were reasonably foreseeable by the Seller.

Without limiting the foregoing clauses, the Seller’s liability under these general conditions may not exceed a sum equal to the sums paid or payable for the transaction giving rise to such liability, whatever the cause or form of the action in question.

The Seller shall not be held liable for breach of contract in the event of failure in stocks or unavailability of the product, force majeure, disruption or total or partial strike, in particular postal services and means of transport and/or communication, flooding or fire. In case of a dispute, the buyer will contact the seller to obtain a friendly solution.

For all civil disputes concerning this contract or related to it, which may arise between the parties, the territorial jurisdiction of the court of the place of residence or domicile of the buyer, if located in the territory of the Italian State, as established by art. 63 of Legislative Decree No 206 of 6 September 2005 "Consumer Code", concerning the competent court.

ART. 11 - ACCESS TO THE CONTRACT AND THESE GENERAL CONDITIONS

Copy of these General Conditions, pursuant to art. 12 paragraph n. 3 of D.L.vo 9 April 2003, n. 70, can be downloaded and saved on the buyer’s computer, by selecting the "Save" button from within the "General Conditions of Sale". A copy of the orders placed by the buyer and governed by these General Terms and Conditions shall be kept in electronic form in the database of the servers operated by the Seller and located in Italy, and may be supplied at the request of the buyer, electronically by sending to the e-mail address indicated by the buyer and at no additional cost, or in hard copy upon payment of the costs of reproduction and shipment of the same. Upon acceptance of the order, the computer system generates a confirmation of the order and the general conditions of the contract, which is sent to the e-mail address indicated by the buyer.

ART. 12 - AMENDMENTS TO THESE GENERAL CONDITIONS

The Seller reserves the right to modify these general conditions of sale without notice, being able to change, delete or add both content and services that are provided through the site and the format in which they appear or with which they are represented on its servers.
These changes will be effective upon their publication on the egeajewels.com website and must be accepted by the buyer each time he makes a purchase through the egeajewels.com website.

Registered users who do not agree with the changes to the General Terms and Conditions must notify this and, from the date on which the new version takes effect, must cease using the services of egeajewels.com

In the event that any of the terms of the general conditions is illegal or inopponibile, it will be null and void and the agreements between the parties will apply and, in their absence, as provided by the Civil Code.

ART. 13 – ESAUSTIVITA’

The purchase does not entail for the purchaser other charges, obligations or expenses than those established in this contract.
